The pablitos tacos mobile message service (the "Service") is operated by Pablito's Tacos (“pablitos tacos”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to pablitos tacos’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of pablitos tacos through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with pablitos tacos. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18339585528 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other pablitos tacos mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

SMS / TEXT MESSAGING TERMS AND CONDITIONS
By opting in to receive text messages from Pablito's Tacos, you agree to the following terms and conditions:
1. Consent & Opt-In
By providing your mobile phone number and opting in, you consent to receive recurring automated marketing and informational text messages (including SMS and RCS) from Pablito's Tacos at the phone number you provided. Consent is not a condition of any purchase. Message and data rates may apply.
2. Types of Messages
You may receive messages related to:

Exclusive promotions, coupons, and special offers
New menu items and limited-time offerings
Order updates and confirmations
Event announcements and location updates
Loyalty rewards and VIP perks

3. Message Frequency
Message frequency varies. You may receive up to 8 messages per month. Message frequency may increase during promotional periods.
4. Opt-Out
You can opt out at any time by texting STOP to any message you receive from us. After texting STOP, you will receive a one-time confirmation message, and no further messages will be sent unless you re-subscribe. You may also opt out by emailing danny@pablitostacos.com with the subject line "Unsubscribe SMS."
5. Help
For help or questions about our text messaging program, text HELP to any message you receive from us, or email danny@pablitostacos.com.
6. Cost & Carriers
Message and data rates may apply depending on your mobile carrier and plan. Pablito's Tacos is not responsible for any charges incurred from your wireless provider. Carriers are not liable for delayed or undelivered messages.
7. Supported Carriers
Major US carriers are supported, including but not limited to AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, and others. Carrier participation may vary.
8. Compatibility
Text messaging may not be available on all wireless devices or through all wireless carriers. Pablito's Tacos is not responsible for messages that are not received due to device or carrier incompatibility.
9. Privacy
We respect your privacy. Your phone number and personal information will not be sold, rented, or shared with third parties for their marketing purposes. Information collected through our SMS program is subject to our Privacy Policy at pablitostacosla.com/privacy. We may share data with our messaging platform provider (Klaviyo) solely for the purpose of delivering messages on our behalf.
10. Age Requirement
You must be 18 years of age or older to subscribe to our text messaging program. By opting in, you confirm that you are at least 18 years old.
11. Modifications
We reserve the right to modify or discontinue the text messaging program at any time, with or without notice to subscribers.
12. Liability
Pablito's Tacos, its affiliates, and any third-party service providers involved in delivering text messages shall not be liable for any delays, failures, or errors in the delivery of any text message, or for any actions taken or not taken in reliance on any text message.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
